About the journal

Desafíos Jurídicos is a biannual publication of the School of Law and Criminology of the Universidad Autónoma de Nuevo León. It contributes to the debate of ideas about law and the interaction of legal issues combined with other disciplines, encourages dialogue, analysis and reflection of contemporary social processes from a perspective that includes a critical academic and scientific vision in order to increase knowledge. Prioritizes the publication of research articles written by national and foreign authors. Promotes links within the social research community. It is aimed at legal and social researchers and, in general, professionals interested in the social areas of knowledge.

With this, the journal focuses on various topics that are circumscribed in the modern concept of transdiscipline; in this sense, all the conjugations of Law in real scenarios, approached with rigor, coming from any part of the world and without limitation as to theoretical or ideological orientation.

The periodicity of the journal is biannual, with the peculiarity that each issue is convened in January and closes in June; it opens in July and closes in December.

The main language is Spanish, although contributions may also be published in English, French or Italian, provided they are accompanied by the corresponding translation into Spanish, which must be provided by the authors themselves. It should be noted that unpublished contributions are encouraged.

The reception of articles for possible publication in Desafíos Jurídicos is permanent throughout the year, being programmed in the corresponding issues.

HISTORY OF THE JOURNAL

The journal Desafíos Jurídicos starts in 2020 and its first publication will be published in 2021 with the aim of disseminating scientific production related to law issues and its operation, its vision is to be a link between academia and society for the understanding of its practice in the social reality to become one of the most important open access scientific bets in Latin America, with the aim of entering the most important scientific indexes and thus facilitate access to an online platform that provides the dissemination of high impact research in law and social sciences.

FOCUS AND SCOPE OF THE JOURNAL

Desafíos Jurídicos is an open access scientific journal published every six months, peer-reviewed, aimed at the dissemination of Law and its praxis, which contributes to the understanding of behavior, legal institutions, models of action, public policies, criminal law, human rights, among others. Likewise, the journal is based on the quality of scientific production, based on systematicity and rigor, uses in its peer review process the double blind review methodology, publishes original articles results of research projects and bibliographic reviews under the guidelines of the publication standards of the American Psychological Association (APA) in its most recent edition.

PEER REVIEW PROCESS

Receipt of an article does not imply its acceptance for publication.

Submission and reception of the article: This stage begins with the submission of the article by the author through the OJS (Open Journal Systems) platform. The author must send the article in Word format, avoiding at all times to include the authors' data and references. Once the article is submitted, the article is automatically received and acknowledged.

Previous Editorial Review: The editors, within a maximum period of 72 hours from the reception of the article, will evaluate the articles submitted and determine if they are within the scope of the journal. In this phase, a review of the editorial quality and the contribution to knowledge of the article submitted is made. Its structure (form and content) is reviewed, verifying that it complies with the publication standards of the American Psychological Association (APA). If the article does not meet the established editorial criteria, the author will be notified of the editorial decision. If, on the other hand, the article passes the pre-review stage, it immediately goes to peer review.

Peer Review: This evaluation is carried out under the double-blind method, that is, the article will be sent in complete anonymity. At this stage, two reviewers, experts in the subject matter, will be appointed to analyze the assigned article, based on editorial policies and taking into account an evaluation format. The reviewers will have a period of fifteen (15) days to carry out their respective review. Once the reviewers issue their concept, the main author is informed. If the article was not accepted by the peer reviewers, the main author is informed. If the article was accepted with some suggestions, the anonymous evaluation is sent to the author so that he/she can make the respective adjustments.

Editorial Review (after peer review): The editor will verify in detail that the authors have made the corrections suggested by the peers.

Proofreading: Once the editor has verified that the corrections have been made, the manuscript will be sent for proofreading. At this stage, the proofreader will take care of the editorial and stylistic aspects of the text.

Translation: After proofreading, if the article is sent only in Spanish, it will be sent to an expert in English to translate the abstract and keywords.

Layout (Editing): This stage seeks to ensure the aesthetic appearance of the article by adapting the spaces, typography and colors.

Editor's final review: The editor grants final approval.

Publication: Articles are in the final stage of the process, ready for publication.

GUIDELINES FOR AUTHORS

Length and Types of Work

 


Articles

The articles must be original and unpublished works of a theoretical, empirical or applied nature, and that are not in the process of evaluation or committed to any other publication; they must be on legal concepts where their relevance and operability in society is visualized, and that contribute to disseminate the topics that derive from the dialogue between law and its reality in daily life. Its length will be between 5,000 and 12,000 words, including the text of tables or charts, maps, graphs, figures, references and notes, scientific articles must consist, at least, of the following sections: Title (Spanish and English), Abstract of maximum 200 words (Spanish and English), Keywords (Spanish and English). Introduction, Theoretical Framework, Methodology, Results, Conclusions, Proposals and Works Cited (minimum 20). Tables, Graphs and Figures should be included in the body of the document properly titled and with the reference of the original source, the format of citation and references will be the one established in the APA Standard with the most updated version. The maximum number of participants in each article will be 4 researchers, who must be properly identified.
Authors will have a maximum of fifteen working days to make the respective corrections in each review (preliminary review, peer review and final adjustments).
Reviews and evaluations of articles are determined by the number of articles on the waiting list. The editorial committee will inform authors about the progress of their work in the evaluation and editing process.
The editorial committee of the journal reserves the right to make style correction and editorial changes it deems necessary to improve the work.
All articles should be sent without the information of who the authors are; the detailed information of the authors of the article should be in the metadata section of the journal's platform.

Critiques

Critiques describe a detailed analysis of legislative precepts or jurisprudential references in search of answers that contribute to an improvement in the legal field, the results reflect an applied research, whether quantitative, qualitative or mixed. Its length will be between 3,000 and 5,000 words, it must include the following sections: Title (Spanish and English), Abstract of maximum 200 words (Spanish and English), Keywords (Spanish and English), Introduction, Theoretical Framework, Methodology, Results, Conclusions and Works Cited.

Reviews

The texts in this section consist of reviews of recent books, journals or academic publications and are obtained at the express invitation of the editorial committee of the journal Desafíos Jurídicos. The work must contain a concrete analysis and reflection of the work, reflecting its essential contributions and contributions. The books to be reviewed must contribute to legal culture and education and include significant national or international findings and sources. Reviews should be between 1800 and 2500 words in length.

 


STRUCTURE FOR THE PRESENTATION OF ARTICLES

Title: It should clearly reflect the objective of the research and it is recommended to be concise, specific and informative.

Abstract: It should have a maximum of 200 words. All information should come from the text of the article. Avoid quotations, abbreviations and bibliographical references.

Keywords: Between 3 and 5 descriptive terms that represent the main content of the article. They should facilitate consultation in databases, consult Thesaurus according to the corresponding subject. They can be compound words. This classification can be consulted at: http://vocabularies.unesco.org/browser/thesaurus/es/

Abstract: It is the same abstract in English in 10-point Arial font. Between the abstract paragraph and the Key Words line there should be one line of space.

Keywords: The same 3 to 5 key words in English.

Introduction: There must be coherence between the title, objective and results stated in the article. The problem, the problem question, the general and specific objectives, the definition of its variables, the limitations, the scope, the justification of the subject and the antecedents with citations in APA Standard with the most updated version.

Development of the paper: It must make correct use of the language and its grammar. It must keep strict correspondence with the other sections of the paper. The internal organization must be coherent and balanced. The contribution of the authors of the article must be clear. Copyright must be respected. This section should indicate the methodology, results and limitations.

Tables, Tables and Graphs: Tables should be numbered consecutively. The same applies to figures, which should be numbered separately from the tables. Each table or figure should be accompanied by a legend that clearly describes the material. Titles should give an account of the content of the information. Tables, figures and photographs should be original to the author(s). If they are modifications or reproductions of another article, they must be accompanied by the permission of the corresponding editor. Charts, graphs, tables, images and other elements should be included in the body of the text in an editable format or attached in the original programs in which they were created.

Conclusions: They should not constitute a repetition of the results. Conclusions should be a reflective reworking of the results with a high level of abstraction. It is different from a final reflection. Quotations should be avoided.

References: The list in alphabetical order of the identification data of the sources cited in the article, should be located at the end of the article and in all cases follows American Psychological Association APA Standards, latest version. It should include all the necessary information that allows the reader to locate the documents cited in a text.

The information must be accurate, as it appears in the original document. They must have recent bibliographical references and periodical scientific publications. The list of references should be 1.5 spaced, each one should have French indentation and should be organized according to the alphabetical order of the surnames of the authors of the sources.

For referencing the number of volumes of a publication it is necessary to use Arabic numerals and not Roman numerals. All authors cited in the body of an article should be referenced at the end. Never reference an author who has not been cited in the text and vice versa.

GENERAL FORMAT FOR PAPERS TO BE EVALUATED

Length: The length should be between 5,000 and 12,000 words, including the text of tables, maps, graphs, figures, references and notes.

Typography: Arial12 point

Format: Justified

Line spacing: 1.5, eliminating spaces before and after each paragraph.

Margins: 2.5 on all four sides.

Sheet: Letter size

Headings: Numbered consecutively.

Footnotes: Numbered consecutively, restricting them to the minimum necessary. Electronic sources are not cited in these notes.

Tables, Graphs, Figures and Images: They should be numbered consecutively and cite the source of origin. This section should be presented in an editable format, not as an image. Word, Excel and Paste Special tools can be used.

Tables should not be presented with vertical lines and the numbering and title should be indicated at the top.

Title: Arial 14 point font in Spanish and English.

Abstract: Arial 10 point font.

Abstract: Arial 10 point font.

Keywords: Arial 10 point font in italics.

Keyword: Arial 10 point font in italics.

Body of the document: Arial 12 point font, 1.5 spacing, justified format without indentation of the first line, numbering titles, subtitles and subtitles, as appropriate.

Works Cited: Arial font, respecting italics according to APA format.

Citations and Bibliography

The bibliographic citations inserted in the text should adhere to the most current APA standards, and each work should have at least 20 works cited, inserting in parentheses the first surname with the first letter in capital letters, followed by the initial of the name, the year of edition and the page number/s (in the case of textual citations).

Example: (Diez, P., 2012: 85).

When quotations comprise less than 40 words, it is required to incorporate them in quotation marks. If the quotation appears in the middle of the sentence, immediately after closing quotation marks, the source is incorporated in parentheses, with the year of publication and page number(s), then the sentence continues.

When the quotation comprises 40 or more words, they are displayed in an independent block of text and the quotation marks are omitted. The quotation begins on a new line and an indentation of approximately 2.54 cm is inserted. At the end of the citation, the source is inserted in parentheses, followed by the year of publication and page number(s).

Example:

Destructiveness is far from being the only option available to man to face the problems and challenges of his existence. Here too, history shows us that in all civilizations, cultures and societies there have been people and groups who, far from choosing destructiveness as a rule of conduct, have opted for constructive ways of being and acting, from friendship and the spirit of harmony to solidarity and mutual help (Saucedo, 2010: 237).

Works by a single author

If the author's name appears as part of the exposition, only the year of publication will be cited in parentheses:

Example: Gomez (2017) "determined that the basic principles of modern science make reference" (p. 385).

If the citation closes the referenced text then the last name is inserted at the end in parentheses, followed by the initial of the first name, the year of publication and the page number/s.

Example: "The basic principles of modern science refer to concrete forms of production" (Gómez, J., 2017, p. 385).

Multi-authored work.

When a work has two authors, both names should be cited each time they appear in the text.

Example: (González, C., & Rivera, P., 2008, p. 168).

When the citation is of three, four or five authors, all authors should be cited the first time they appear in the text and in subsequent times only the last name of the first author followed by the abbreviation et al. (without italics and with a period after al) and the year should be included.

Examples:

González, Núñez, Hibrón and Ochoa (2017) when the citation begins the paragraph.
González et al. (2017) in subsequent paragraph-starting citations.
(González, Núñez, Hibrón, & Ochoa, 2017) when the citation is inserted between paragraphs or at the end of the paragraph.
(González et al., 2017) in subsequent citations between paragraphs or at the end of the paragraph.

Works Cited

The list of works cited will be indicated at the end of the article with complete references in the established APA format.

They should be ordered alphabetically by surname.

In case of several citations of the same author and for the same year, the works will be differentiated by consecutive lowercase letters following the year (a, b, c, d...).

Example:

(Gutiérrez, L., 2018a.)
(Gutiérrez, L., 2018b.)

Electronic resources will be cited in a separate section mentioning: Author/a, year, title, type of resource, date of publication and date of consultation.

 


Tables, Charts, Maps, Graphs and Figures.

All the inclusions of these characteristics should be numbered correlatively (1, 2, 3,...); they will be identified with a brief title and the source and year should be indicated.

Images should be presented in jpg or png format.

Open access policy
This journal provides immediate open access to all its contents, based on the principle that offering the public free access to research helps a greater global exchange of knowledge. Therefore, the journal does not charge article processing fees (No APC) or publication fees for its articles.

Ethical statement on publication and good editorial practices
The journal Desafíos Jurídicos is committed to the scientific community to ensure the ethics and quality of the articles published. Our journal has as a reference the Code of Conduct and Good Practices defined by the Committee on Publication Ethics (COPE) for editors of scientific journals (http://publicationethics.org). At the same time, it guarantees an adequate response to the needs of readers and authors, ensuring the quality of what is published, protecting and respecting the content of the articles as well as their integrity. The editor

Take care of impartiality both in the reception of articles and in the evaluation decision.
Act at all times in accordance with the editorial criteria and the editorial line.
The academic review of articles is governed by the blind peer review system, so the journal is committed to protect the anonymity of authors and reviewers.
Desafíos Jurídicos is financed with public resources and adheres to the open access philosophy; therefore, its content has no commercial purposes, which is guaranteed at all times by the editorial team.
The editorial team is available to clarify doubts to authors and reviewers during the review and editing process.
The editorial director guarantees that the result of the review process will be made known exclusively to the authors, through the Open Journal Systems (OJS) platform.
Plagiarism conducts are not admitted in Desafíos Jurídicos, in this sense, articles are evaluated with specialized software. Any case detected will imply the rejection of the article, which will be notified to the authors of the article and they will not be given the possibility of submitting another manuscript to the journal.
In those cases where it is required, the journal will make public the corresponding and necessary clarifications and corrections.

Authors

Authors must guarantee that the articles are the product of their original work as researchers and that the data presented have been obtained in an ethical manner, so they must send the letter of originality and guarantee that they do not infringe copyright.
The article may not be submitted in whole or in part to another publication.
Authors may not submit redundant publications, understood as when two or more papers share the same data, hypotheses, discussion points or conclusions.
Co-authored papers must have a justification that expresses the full consensus of the adherence to the guidelines of all authors involved.
Authors must guarantee strict adherence and acceptance to the editorial criteria established by Desafíos Jurídicos.
Authors are obliged to respect the authorship of all the sources that have been used in the elaboration of their article; therefore, they must provide the exact data of the bibliographic, hemerographic, electronic references and other data collection techniques. Likewise, he/she undertakes not to omit any significant material.
Attend to the observations of the editorial and academic opinions in a punctual and clear manner.
Failure to comply with the above points constitutes unethical and unacceptable conduct; consequently, the proposed article will be eliminated and will not be considered for publication; likewise, the author will not be considered for any activity related to the journal.

Reviewers

They must undertake to maintain the confidentiality of the information related to the articles they evaluate.
They may not make any type of diffusion or distribution of the information presented in the article they evaluate until it is published by the journal.
Commit themselves to carry out the opinion in an objective, impartial, responsible and rigorous manner.
Demonstrate willingness to clarify doubts and all matters related to compliance in each of the stages that comprise the review process.
In the event of any failure to comply with the above points, the journal reserves the right to deliver proof of membership in the referee portfolio.

Academic endogamy

In accordance with international standards, Desafíos Jurídicos seeks to avoid academic inbreeding in the articles it publishes. Consequently, it will only publish a maximum of 40% of articles whose author(s) is (are) someone whose main institutional affiliation is the Universidad Autónoma de Nuevo León, taking into consideration the total number of articles to be published in all sections of the journal.

Priority for publication of articles will be established according to the date on which they are approved.
