Dynamics of Contemporary Law: Pluralism, Institutional Transformation, and New Frontiers of Fundamental Rights

Abstract

The eleventh issue of the Revista Desafíos Jurídicos addresses the ongoing ontological and dogmatic restructuring of Law across Ibero-America. It points out that traditional legal frameworks—long anchored in formalist and state-centered positivism—are facing profound tensions under the weight of contemporary social complexities. Consequently, the validity of today's legal system can no longer depend solely on the formal legality of its sources, but rather on its concrete guarantee capacity and effectiveness. To bridge this gap, the text highlights the imperative need to integrate legal pluralism, a structural gender perspective, and robust human rights standards into judicial practice, thereby ensuring the protection and visibility of historically marginalized sectors, groups, and ideas.
