Expert testimony confronts two discourses with conflicting aims within the adversarial criminal justice system: evidence and the legal process. These two aspects present a challenge to the legal regulation of evidence, a challenge not shared by other types of evidence. Mauricio Duce addresses this issue with two key points: a) the admissibility of expert testimony in court, based on an analysis of the rules governing its use, given the specific context of the legal system; and b) the practical aspects of litigating expert testimony in oral proceedings, considering that, due to its unique characteristics, the presence of expert evidence in criminal oral proceedings demands specialized preparation for its handling
