This paper analyzes the constitutional validity of Article 279 of the Civil Code for the State of Nuevo León, which regulates no-fault divorce, through the lens of gender perspective and human rights. It is proposed as a solution to the problem arising from the use of this legal mechanism by the male spouse as a means to evade alimony obligations toward the woman. The article argues that the legal provision in question results in indirect discrimination, violates the rules of due legal process, and infringes upon the principle of judicial independence, particularly in its aspect concerning the separation of powers.
