ANALYSIS OF THE DESIGNATION PROCESS OF THE CITIZEN PARTICIPATION COMMITTEE OF THE STATE ANTI-CORRUPTION SYSTEM IN THE STATE OF NUEVO LEÓN

In this work, an analysis is made of the sentence handed down on July 13, 2019, by the Second Collegiate Court on Administrative Matters of the Fourth Judicial Circuit, within the amparo under review 356/2019, in which it ordered the Selection Committee of the State Anti-Corruption System of the State of Nuevo León, to render void the opinion and agreement issued in the Session dated August 30, 2019, in which the Selection Committee of the State Anti-Corruption System proposed and granted the appointment to the five members that make up the Citizen Participation Committee of the State Anti-Corruption System in the State of Nuevo León.
This, to form a criterion that the amparo trial is an ideal means of constitutional control to challenge decisions and rulings of the "entities or collegiate bodies" (selection committee) temporarily created by the Legislative Branch, which within its functions is to make public calls and select candidates to occupy public positions, as well as establish the illegality of the selection process since they are subject to the principles of "due process, justification and motivation."
