The evolution of criteria regarding the “burden of proof in civil processes” and “people with disabilities” in light of the resolution issued on December 15, 2022, by the Third Collegiate Court in Civil Matters of the Fourth Judicial Circuit, within direct protection 485/2021

In this paper a critical analysis is made of the resolution presented on December 5th, 2022 by the Third Tribune Collegeate in Civil Case of the Fourth Judicial Cirquit, within the amapro directo (Direct Resolution of the Mexico Supreme Court) 485/2021, where it ordered the Nineth Civil Hall of the Supreme Court of Justice of the Nuevo León State, leaving without effect the resolution permitted on June 30th, 20201. This in order to find out if the above mentioned resolution adjusts to the doctrin generated by the Justice Supreme Court of Nuevo león, tied to the “burden of Proof in the processes of civi nature” y disabled people.
