The visitation regime of the non-custodial parent is a crucial issue in family law, as it directly impacts the emotional well-being and psychosocial development of minors. This article analyzes the legal and regulatory framework governing these visits, considering Mexican legislation, international treaties such as the Convention on the Rights of the Child, and empirical studies that highlight their significance in children's upbringing.
From a psychosocial perspective, the article examines the positive effects of maintaining a continuous relationship with both parents on a child's self-esteem, emotional stability, and social skills. It also addresses associated challenges, such as non-compliance with court orders, parental alienation, and lack of communication between parents—factors that can negatively impact the parent-child relationship and the child’s development.
Furthermore, the study highlights the consequences of non-compliance with the visitation regime and the legal sanctions that may apply, emphasizing the importance of ensuring the child’s right to maintain contact with both parents. The article underscores the need for comprehensive approaches, including family mediation, professional supervision, and co-parenting strategies, to provide a stable and healthy environment for minors.
This study offers an interdisciplinary perspective on the visitation regime, integrating legal and psychosocial analysis to reinforce the importance of shared parenting for the holistic development of children.
