Abstract

This analysis addresses the central issues of the resolution of direct appeal for review 6213/2026, regarding the debate on the unconstitutionality of section 10 of the Regulations on Infectious Diseases and Radioactive Emissions, incorporated into the collective bargaining agreement signed between the Mexican Social Security Institute (IMSS) and the National Union of Social Security Workers (SNTS). employees of the IMSS who perform their duties with a high risk of infectious diseases, excluding those who do not perform their duties under the same conditions. Given this exclusion, the analysis examines whether the distinction between personnel is justified and reasonable, or discriminatory and arbitrary, and, furthermore, whether this regulation is recognized as a positive measure that the State or its private entities must adopt to guarantee the right to health for all people.
