This paper criticizes the jurisprudence issued by the First Chamber of the Supreme Court of Justice of the Nation, in which it declares that the refusal of access to the investigation folder to victims and offended persons cannot be challenged through the unnamed remedy provided for in article 258 of the National Code of Criminal Procedures. This, to know if such a precedent conforms to the doctrine previously generated by that Chamber and if it guarantees the rights of the victims and offended.
