El usurpador de funciones y la responsabilidad penal en la Administración Pública

This research seeks to analyze the relationship between public administration as a provider of public services and welfare through the realization of the common good. We also analyze those who represent public administration through the different legal mechanisms that can be used for the enrollment of public servants within the administration. Next, we analyze the figure of the usurper and the simulator of functions and the criminal conduct of typification, unlawfulness, and culpability. Subsequently, we review the crime of usurpation and simulation of functions, as well as its relationship to other crimes such as embezzlement, bribery, extortion, or illicit enrichment, and then review some cases resolved by the National Court of Justice of Ecuador.
